By subscribing to or using any of our services, you agree that you have read, understood, and are bound by the terms, regardless of how you subscribe to or use the services.

"Website" is an internet-based content and e-commerce portal operated by Kian Elegance Pvt. Ltd., a company incorporated under the laws of India.

Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions, and notices contained in these terms, as may be posted on the Website occasionally. At its sole discretion, Kian Elegance reserves the right not to accept a User from registering on the Website without assigning any reason.

Eligibility:

Use of the Website is available only to those who have attained the age of majority and are competent to enter into legally binding contracts under applicable law. If you are a minor, you may use the Website only under the supervision of a guardian, a parent, or a legal guardian who agrees to be bound by the terms and conditions. This Website is not available to persons whose registration has been suspended or terminated by Kian Elegance Pvt. Ltd. for any reason.

User Account, Password, and Security:

Upon completing the Website's registration process, you will receive a password and account designation. Alternatively, you can browse an existing Gmail or Facebook account by providing the necessary permissions. You are responsible for maintaining the confidentiality of the password and account. You are fully responsible for all activities under your password or account.

You agree to:

Immediately notify Kian Elegance of unauthorized use of your password, account, or security breach.
Ensure that you exit from your account at the end of each session. Kian Elegance cannot and will not be held liable for any loss or damage arising from your failure to comply with this section.

By registering to our Website, you agree to receive marketing and promotional communication from Kian Elegance via SMS, WhatsApp, Email, and any other form of notification(s).

As a part of the registration process on the Website, Kian Elegance shall collect certain personally identifiable information about you. Kian respects the sensitivity of the information provided to you, and we appreciate your trust in us.

The User agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website. Limited reproduction and copying of the Website's content is permitted provided that Kian Elegance's name is stated as the source and prior written permission of Kian Elegance is sought. User Warranty and Representation:

The user guarantees, warrants, and certifies that you are the owner of the content you submit or otherwise authorized to use the content and that the content does not infringe upon the property rights, intellectual property rights, or other rights of others. You further warrant that to your knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name, service mark, and copyright formerly or currently used by you in connection with the services rendered by Kian Elegance Pvt. Ltd.

Disclaimer: The customers are responsible for logging in earlier if they want better products or styles because Kian Elegance sales are "first come, first served." The merchandise is not restocked once it is sold out. No information regarding the presence of any Product in our stock will be guaranteed, and we will alert you only when an item is sold out.

The terms and conditions for such a Contest shall be separately available on the site. In the event of any conflict between these T&Cs and the terms and conditions of any Contest, such terms and conditions shall prevail.

As a merchant, we shall be under no liability regarding any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Our Online Website is presented "As Is." We make no representations or warranties of any kind whatsoever, express or implied, in connection with these terms and conditions or the site, including but not limited to warranties of merchantability, non-infringement, or fitness for a particular purpose, except to the extent such representations and warranties are not legally excludable.

You agree that, to the fullest extent permitted by applicable law, we will not be responsible or liable (whether in contract, tort (including negligence) or otherwise), under any circumstances, for any (a) interruption of business; (b) access delays or access interruptions to the site; (c) data non-delivery, mis-delivery, corruption, destruction or other modification; (d) loss or damages of any sort incurred as a result of dealings with or the presence of off-website links on the Website; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party websites (f) any inaccuracies or omissions in content or (g) events beyond our reasonable control.

Kian Elegance's personal care products are home-based formulations. Though enormous efforts are made, and precautions are taken to render the products safe for human use, certain ingredients may cause allergic reactions to specific individuals or adversely affect individuals with pre-existing medical conditions. Please make yourself aware of the ingredients and usage instructions accompanying each of our products to ensure they are safe for you to use. You will be responsible for taking proper precautions/ professional medical/ dermatological advice before using any of our personal care products you may be allergic to. You agree that Kian Elegance will not be responsible or liable for any product-related issues, including any allergic reactions to you, on account of the usage of our products. Any purchases made through the "website address" will be governed by the limitation of liability and disclaimer conditions provided in more detail with the product packaging/leaflets.

Further, to the fullest extent permitted by law, we will not be liable for any indirect, special, punitive, incidental, or consequential damages of any kind (including lost profits) related to the Website or your use thereof, regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages and in no event shall our maximum aggregate liability exceed INR 2,000 only.

You agree that no claims or action arising out of, or related to, the use of the Website or these terms and conditions may be brought by you more than one (1) year after the cause of action relating to such claim or action arose.

Products and Services offered:

The service enables users to buy original merchandise such as Skincare and Haircare (collectively, "Products"). Upon placing an order with us for the purchase of product(s), you will receive an email from Kian Elegance confirming receipt of your order and containing details of your order ("Order Confirmation"). The Order Confirmation is merely an acknowledgment that we have received your order and does not signify our acceptance of your offer.

We only accept your offer and conclude the contract of sale for a Product(s) ordered by you when the Product(s) is/ are shipped or dispatched to you ("Shipment Confirmation"). Kian Elegance shall ship the Product to you and be entitled to its payment for the services.

You may receive separate shipment confirmation for each parcel if your order is dispatched in multiple packages. Each shipment confirmation and corresponding dispatch will conclude a separate contract of sale between you and us for the Product(s) specified in the Shipment Confirmation.

The Products and services available on the web and the samples, if any, that the platform may provide you are for your personal and/or professional use only. The products or services, or services thereof, which you may receive from us shall not be sold or resold for any/ commercial reasons. We reserve the right, with or without notice, to cancel or reduce the quantity of any products or services provided to you that we believe, in our sole discretion, may violate our terms and conditions.

We attempt to be accurate when describing our products on the Website. The weights, dimensions, and capacities given are approximate only. However, as the actual image you see will depend on your monitor, we cannot guarantee that your monitor's display of any image will accurately reflect the Product's color, texture, and general appearance on delivery. The Product pictures are indicative and may not match the actual Products. However, except to the extent implied by applicable law, we do not warrant that the product description, colors, information, or other content available on the Website are accurate, complete, reliable, current, or error-free.

Fulfilling all orders placed on the Website is subject to the availability of such Product (s).

All products are manufactured by "address" and marketed by "address."

User conduct rules:

You agree to use the Website and the Service only to post and upload proper messages and material. By way of example, and not as a limitation, you agree and undertake that when using a Service, you will not:

Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others;

Exploit any of the services. We reserve the right to deprive individual customers of our Cash on Delivery payment option. Moreover, we might refuse any of our services, terminate accounts, and/or cancel orders at our discretion, including but not limited to if we believe that customer conduct violates applicable law or harms our interests.
You shall not make any derogatory, defamatory, abusive, inappropriate, profane, or indecent statement/s and/or comment/s about Kian Elegance, its franchisor, associates, and partners on any property owned by Kian Elegance.

Usage and Product pricing:

You understand and agree that any side effect caused by the Product (s) purchased by you on the Website shall not make Kian Elegance liable in any manner whatsoever. You agree to carefully read the individual descriptions of the products and consult a specialist if required.

Product pricing is described on our Website and incorporated into these Terms by reference. All prices are in Indian rupees. Prices, products, and services may change at the Kian Elegance's discretion. All prices are displayed inclusive of GST. Please note that the pricing of product (s) is subject to fluctuations, and adding Product (s) to your shopping cart is not a guarantee of Product(s) being available at the same price in case the order is not placed immediately after adding the Product (s) to the shopping cart. Transactions through the Website may be subject to a delivery charge where the minimum order value is unmet. You will be informed of such delivery charges at the stage of checkout.

MRP Disclaimer: Some of our products in the offline and online channels may vary subject to the date/ period of manufacturing and/or import date. However, it always remains intact as declared on specific Products during manufacturing.

We sometimes run promotions that might entail a gift or a product on your purchase at the "website." Please note that these promotional products might or might not have a best use date of more than one year, and you have the complete discretion to accept or remove the Product from the cart.

Links to Third-Party Sites:

The Website may contain links to other websites ("Linked Sites"). Kian Elegance or the Website does not control the Linked Sites. Kian Elegance is not responsible for the contents of any Linked Site, including any link contained in a Linked Site or any changes or updates to a Linked Site. Payments:

Payments can be made by Credit Card, Debit Card, Net Banking, Cash-on-delivery, or other payment gateways or other payment options available on the Website. You will be informed about the modes of payment that are available at the time of placing the order. You might be required to provide your credit or debit card details to the approved payment gateways while making the payment.

You agree, understand, and confirm that the credit/debit card details or other financial details provided by you for availing of services on the Website will be correct and accurate.

You shall not use any credit /debit card or other financial facility that is not lawfully owned/obtained by you or where you do not have the express authority from the owner to use the same. You also understand that any financial information you submit is not stored on the Website.

Kian Elegance shall not be liable for any credit/debit card fraud, nor shall it be responsible for any unauthorized use of your debit/credit card for placing an order. The liability for the fraudulent use of a card will be on you, and the onus to prove otherwise shall be exclusively on you. You will be solely responsible for the security and confidentiality of your credit/debit card details.

Upon successfully placing the order, you will receive a confirmation of your Order Confirmation, as set out hereinabove. If your payment is successful, but you do not receive an Order confirmation from us, don't hesitate to contact us (refer to the "Contact Us" portion of the Website).

Kian Elegance will not be responsible if the bank or payment service provider declines the payment transaction you initiated. Please note that payment/ gateway services offered by third parties would be subject to the terms and conditions specified by such third parties.

Kian Elegance shall not be responsible if an order is not registered or is lost due to any network problems such as breakdown of machinery, unclear/ disruption in the network, or non-receipt of payment from banks/payment gateways and/or the cost(s) charged by the network operator(s). Any dispute in connection to the same shall be settled between the Customer and the network operator without involving Kian Elegance.

Shipping and Delivery Policy:

Delivery Procedure: You agree that the products are carefully inspected after our system has processed your order to ensure they are in good condition. Products are packaged and handed over to our reliable delivery partners after a final round of quality inspection. The package is then delivered to you by one of our delivery partners as soon as possible. Our delivery partners may contact you should they face any trouble locating your address or should there be any unforeseen delay.

Packing: As part of our commitment to the environment, we will continue to focus on reducing our packaging, which minimizes the impact on our environment. Our products are also packaged to provide sufficient 'head space' to minimize content leakage, sometimes resulting in cream shifting within the container during delivery.

Tracking Information: You will receive an email after your order has been shipped out with information on the tracking number and the courier service handling your order. You can check the status of your package 24 hours after your order is dispatched from our warehouse. You understand that the status of your order may take 24 hours or such other time as may be necessary due to unforeseen circumstances beyond Kian Elegance's control.

Delivery Timeline: Most orders are typically shipped out in 1-2 business days (excluding Sundays and public holidays) and delivered as per the estimated time of delivery provided on the product page/product cart. You acknowledge that delivery may be delayed depending on the source of dispatch, warehouse, and destination pin code. The estimated delivery date will be communicated to you once the Product has been shipped.

However, product delivery may get delayed due to reasons beyond our control or attributable to logistics, national and public holidays, riots, political disturbance, natural calamity, acts of God, or any other such force event. You agree that no refund or cancellation will be allowed due to any delay in delivering the products within the estimated time of delivery provided on the Website and/or communicated to you.

Suppose you are ordering our products from a Mega Sale event. In that case, dispatches may be delayed due to increased order volumes.

You acknowledge that one order with more than one Product may be delivered in multiple shipments due to different warehouse locations.

Refund and Cancellation Policy:

Cancellation Process: You can cancel your order within one hour of placing the order on the Website before the products in your order have been dispatched through the following mechanisms:

From your account on the Website; or
Via chat service enabled on the Website.

If an order is not canceled within one hour, you will not be allowed to cancel the order. A complete refund will be initiated for prepaid orders canceled within one hour of placing the order on the Website. The money will be refunded within 24-48 business hours after we process the cancellation request.

Kian Elegance reserves the right to refuse the transaction or delay the refund process by 3-6 months for users with a history of questionable charges, such as canceling bulk orders/ orders. Such cancellation has occurred more than once.

Note: Gift cards are not eligible for cancellation.

Return Process: You may place a return request within 48 hours from the delivery date. When a shipment is returned after it has been delivered, your return request may be approved based on the quality checks conducted by our team. The refund will be initiated once the Product (s) have been picked up from your location.

Within 24-48 business hours of us picking up the Product (s) from your location, the refund for purchases made with credit/debit cards or net banking will be credited to the same account from which the payment was made. The amount may not appear in your account for another 3-7 working days. For orders that have been paid through cash on delivery mode, the amount will be refunded to your bank account after we have collected the details.

Note: Gift cards are not eligible for returns.

Refunds, Replacements, and Returns: You understand that a return request may be made for a part of your or entire order. You understand that the return option is only available in the following scenarios:

Product/(s) have been spoilt/damaged in transit; or
Product/(s) that arrive in damaged packaging; or
A wrong product has been delivered.

Kian Elegance shall not be obligated to accept returns for products that are not spoilt, wrong, or damaged.

You understand that a replacement request is subject to the availability of stock. Suppose a replacement cannot be carried out due to non-availability of stock. In that case, the amount will be refunded to you. You understand that you can only raise a replacement request for the same Product if the Product delivered to you has been damaged in transit, is wrong, or delivered in a damaged package. You acknowledge that a replacement request cannot be placed for a different product; an exchange of a product will not be permitted under any circumstances.

Note: Gift cards are not eligible for cancellation.

Process for submitting a return, replacement, and refund request:

Select the reason for return, replacement, or refund (as the case may be) by choosing a particular option on the Website.
Add four images of the Product received in the manner specified below:
The front image of the Product along with the name of the Product.
The back image of the Product.
Image of the barcode on the product box.
Image of the outer box packaging of the Product.

Products not eligible for return: The following products are not eligible for return in any circumstances:

Products damaged/degraded as a result of use, overuse;
Products that have missing items and damaged original packaging, including price tags, labels, tampered packaging, gifts, and other accessories; and
Products with altered serial numbers.

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In detecting any suspicious activity, Kian Elegance reserves the right to cancel all past, pending, and future orders without liability. Kian Elegance also reserves the right to refuse or cancel orders in scenarios like inaccuracies in product pricing on the Website and stock unavailability. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your card has been charged, the amount will be refunded to your card account. Any promotional voucher used for the canceled orders may not be refunded.

Indemnification:

You agree to defend, indemnify, and hold harmless Kian Elegance, its owners, licensee, affiliates, group companies (as applicable), and their respective employees, directors, shareholders, officers, agents, and their successors and assigns ("Indemnified Parties") from and against any claims, liabilities, damages, losses, costs, and expenses, including attorney's fees, caused by or arising out of your actions or inactions including but not limited to a breach of any warranties, representations or undertakings or concerning the non-fulfillment of any of your obligations under the Terms and Conditions or arising out of your violation of any applicable laws and regulations, infringement of intellectual property rights, non-payment of statutory dues and taxes, libel, defamation, violation of rights of privacy, or loss of service by other subscribers attributable to you.

This clause shall survive the termination of your legal relationship with Kian Elegance.

Termination and Severability:

Kian Elegance may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion, that you have breached any of the Terms.
Suppose you or Kian Elegance terminate your use of the Website or any Service. In that case, Kian Elegance may delete any content or other materials relating to your service use. Kian Elegance will have no liability to you or any third party for doing so.
You shall be liable to pay for any Service or Product that you have already ordered till the time of termination by either party whatsoever. Further, you shall be entitled to your royalty benefits as per the Policy that has or is legally deemed accrued to you.

Suppose any provision of the terms is determined to be invalid or unenforceable in whole or in part. In that case, such invalidity or unenforceability shall attach only to or part of such provision. The remaining part of this and all other provisions of these Terms shall continue to be in full force and effect.

Limitation of liability:

The aggregate liability of Kian Elegance, if any, that is established and ordered by a court of competent jurisdiction according to a claim shall in no event extend beyond a refund of the money charged from a Customer for purchases made according to an Order under which such liability has arisen and been established.

It is acknowledged and agreed that, notwithstanding anything to the contrary contained herein, Kian Elegance shall not be liable, under any circumstances, whether in contract or tort, for any indirect, special, consequential, or incidental losses or damages, including on the grounds of opportunity loss, loss of profit, loss of reputation or loss of business opportunities.

References on this Website to any names, marks, products, or services of third parties or hypertext links to third-party sites or information are provided solely as a convenience to you and do not in any way constitute or imply Kian Elegance endorsement, sponsorship, or recommendation of the third party, information, Product or service.

Kian Elegance is not responsible for the content of any third-party sites. It does not make any representations regarding the content or accuracy of material on such sites. If you decide to use the link to any such third-party websites on the Website, you do so entirely at your own risk.

In no event shall Kian Elegance and/or its representatives be liable for the use or inability to use the Website; any content posted, transmitted, exchanged, or received by or on behalf of any user or other person on or through the Website; or any unauthorized access to or alteration of your transmissions of sensitive personal information or other user data.

Governing Law and Jurisdiction:

These terms shall be governed by and constructed per the laws of India without reference to conflict of laws principles. Disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at "Place."

Terms for promotions/Contest/Offers/ Campaigns:

Discounts will be applied to the total merchandise value, including GST and applicable taxes. Issuance or redemption of a voucher or coupon will apply to the full value of the qualifying order once all promotional discounts have been applied.
Unless otherwise stated, only one credit note/gift coupon/coupon can be used per order.
Discount coupons - Discount coupons may be offered to account holders; such coupons may only be applied to purchases made through the account to which the discount coupon was offered and registered. If you need a refund, this will be made the same way as the original payment method (such as onto a gift voucher, debit/credit card account, a combination of the two, and, in case of COD, a Bank Transfer).
Promotional discount coupons - We may occasionally offer promotional discount coupons that may apply to any specific specified purchases made through this Website.
Kian Elegance shall introduce various offers, schemes, or contests at different times. Two separate offers cannot be clubbed unless mentioned on the site.
Kian Elegance reserves the right to change/modify/add/delete any of the terms and conditions prevailing on the different promotional schemes it introduces in the market occasionally. At its discretion, Kian Elegance can withdraw a particular scheme from the Website or market.

While participating in any Kian Elegance contest, you, as a result of this, agree to release and hold Kian Elegance (and its officers, directors, agents, subsidiaries, affiliates, joint ventures, and employees) harmless from any claim or demand, but not limited to reasonable attorneys' fees, or arising out of or related to your participation in the said contest.
Kian Elegance reserves the right to cancel any orders placed using promotional vouchers. Some situations where your order may be canceled include, without limitation, misuse of any promotional vouchers, unauthorized usage of vouchers, or inaccuracies of voucher pricing and value thresholds. The voucher amount will not be refunded for such cases.
Suitable legal action will be taken against websites involved in the unauthorized publication of Kian Elegance vouchers. Kian Elegance will only honor vouchers issued or published directly by us or our partner websites.

Report Abuse:
